Terms of Service

These Terms of Service ("Terms") govern your access to and use of EngageApp. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Service description

EngageApp provides multi-channel retention and lifecycle messaging (including email, SMS, WhatsApp, push, in-app, and custom API channels where enabled), campaigns, segments, events, and related tools. Features available to you depend on what is shipped in the product and any channels or integrations you connect. Message delivery depends on third-party providers and networks you configure; we do not guarantee delivery.

2. Accounts

You must provide accurate registration information and keep credentials confidential (including API keys). You are responsible for activity under your account. Notify us promptly of unauthorized use.

3. Acceptable use

You agree not to:

• Send spam or unlawful, deceptive, or harassing messages
• Violate applicable law (including privacy, telecom, and anti-spam rules) in places you message
• Transmit malware or attempt to disrupt or break into the service
• Misuse integrations or scrape the service beyond documented APIs
• Resell EngageApp access except as we expressly allow in writing

4. Messaging compliance

You are solely responsible for message content and for obtaining required consents and opt-outs from recipients (including WhatsApp template and policy requirements when you use WhatsApp). EngageApp is a tool; compliance remains yours.

5. Credits and billing

EngageApp uses prepaid credits. Successful sends consume credits at the rates shown in-product and on our pricing page, subject to any disclosed managed SMS surcharges. Some in-product AI or Autopilot features may also consume credits at the rates shown in the product. Failed sends that the product does not bill do not consume credits where the product states that. Credits do not expire unless we say otherwise in-product. Packs are prepaid; there is no monthly fee solely for storing contacts on the current pricing model. Credits are non-refundable except where required by law or we expressly agree.

We may change pricing with notice. Continued purchase or use after notice constitutes acceptance of new prices for future usage.

6. Your data and license

You retain rights to your content and customer data. You grant us a limited license to process that data solely to provide and secure EngageApp. See our Privacy Policy.

7. Intellectual property

EngageApp software, branding, and documentation are owned by Mantissa Software Solutions Limited or its licensors. You may not reverse engineer or copy the product except as allowed by law.

8. Third-party services

Integrations and channel providers (Shopify, WooCommerce, email/SMS/WhatsApp/push providers, payment processors, and others you connect) are third-party services. Their terms and availability are outside our control.

9. Availability and disclaimer

We aim for reliable service but do not warrant uninterrupted or error-free operation. The service is provided "as is" to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, Mantissa Software Solutions Limited is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to EngageApp will not exceed the amount you paid us for EngageApp in the 12 months before the claim.

11. Indemnity

You will indemnify Mantissa Software Solutions Limited against claims arising from your messages, your customer data, your misuse of the service, or your violation of these Terms or law.

12. Suspension and termination

We may suspend or terminate accounts for Terms violations, abuse, unpaid obligations, or risk to the platform. You may stop using EngageApp and request account closure via /data-deletion or https://engageapp.xyz/contact. Unused credits may be forfeited on termination except where law requires otherwise.

13. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of Nigeria. Disputes are subject to the courts of Lagos, Nigeria, unless mandatory consumer law says otherwise.
